Terms of Service

1. Acceptance of terms

These Terms of Service ("Terms") govern the use of nomad os ("the Platform" or "the Service"), operated by The NMD SpA, Chilean tax ID (RUT) 78.129.741-0 ("The NMD Studio", "we"). By creating an account or using the Platform, you accept these Terms and our Privacy Policy. If you do not agree, you should not use the Service.

2. Service description

nomad os is an agency-management platform that lets you manage meetings, a content calendar, Meta Ads campaigns, email marketing, and client information, including optional connections with Google Calendar, Meta (Facebook), and Instagram to sync and publish content on behalf of the user who authorizes that connection.

3. User accounts

There are two types of account: team accounts (created by an agency administrator/"owner") and client portal accounts (created by the agency for its own clients). There is no public sign-up — every account is created by whoever administers the agency.

You are responsible for keeping your password confidential and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized use.

4. Permitted use

You agree to use the Platform lawfully and not to:

• Attempt to access accounts, data, or clients that are not yours.
• Use the Platform to publish illegal, defamatory content, or content that infringes on third-party rights.
• Attempt to breach the Service's security or interfere with its normal operation.
• Use the Google, Meta, or Instagram connections for purposes other than the ones you explicitly authorized.

5. Connecting third-party platforms

By connecting a Google, Meta, or Instagram account, you authorize nomad os to access the information and perform the actions described in our Privacy Policy, on your behalf and under your responsibility. You may revoke any connection at any time. We are not responsible for changes, outages, or limitations those platforms impose on their own APIs, nor for content you publish through them.

6. User content

You own the content you upload to the Platform (images, videos, documents, text). You grant us a limited license to store, process, and display that content solely to provide you the Service (for example, publishing it to Instagram when you explicitly request it). We do not use your content for any other purpose.

7. Service availability

We work to keep the Platform available and functioning correctly, but we do not guarantee uninterrupted or error-free operation. The Service depends in part on third-party providers and APIs (Google, Meta, Instagram, Supabase, Vercel) outside our direct control.

8. Limitation of liability

To the maximum extent permitted by Chilean law, The NMD Studio will not be liable for indirect, incidental, or consequential damages arising from use of the Service, including data loss, or outages or failures of connected third-party platforms.

9. Intellectual property

The software, design, brand, and functionality of nomad os are owned by The NMD SpA. These Terms do not grant you any right over that intellectual property beyond normal use of the Service consistent with your account type.

10. Termination

We may suspend or remove an account that violates these Terms. You may request the deletion of your account and your data at any time by writing to us at emilia@thenmdstudio.com.

11. Changes

We may update these Terms from time to time. Continued use of the Platform after an update constitutes acceptance of the new Terms.

12. Governing law

These Terms are governed by the laws of the Republic of Chile. Any dispute arising from these Terms will be submitted to the ordinary courts of justice of Chile.
